    ECI/PN/47/2019 Dated: 15th April, 2019 Press Note Commission Reviews Poll Arrangements with Central Observers in Tripura and West Bengal through Video Conferencing for next Phases of Polling Chief Election Commissioner Sh Sunil Arora and Election Commissioners Sh Ashok Lavasa and Sh Sushil Chandra today reviewed poll arrangements in specific constituencies of West Bengal and Tripura going to polls in Phase 2 & 3 of ongoing General Elections to Lok Sabha 2019. The review through video conferencing was held with General Observers, Police Observers and Expenditure Observers deployed in Phase 2 and Phase 3 Parliamentary Constituencies in West Bengal namely the 3-Jalpaiguri, 4-Darjeeling, 5- Raiganj, 6- Balurghat, 7-Maldaha Uttar, 8-Maldaha Dakshin, 9-Jangipur and 11- Murshidabad in West Bengal and Phase 2(final phase) of Tripura ie 2-Tripura East Parliamentary Constituency. The General Observers briefed the Commission on the preparedness in terms of Assured Minimum Facilities (AMF) at the Polling Stations; mapping of PWDs and the arrangements made for their facilitation at the Polling Stations; Awareness amongst the voters that Photo Voter Slips (PVSs) will no longer be treated as the Identification document but that the Voter has to necessarily bring one of the 12 specified Identification Documents to be shown at the Polling Station on the poll day. Commission also reviewed the complaints, if any, from Political Parties, etc as received by Observers and their status. The preventive actions taken against the identified trouble makers and potential intimidators were also reviewed. Commission reviewed at length the Central Armed Police Forces deployment status in each of the Parliamentary Constituencies. The Police Observers briefed about Preparation of District Security/Force Deployment plan; Use of Central Paramilitary Forces for area domination and confidence building measures and the Law and Order situation. The Special Central Police Observer for West Bengal and Jharkhand Sh Vivek Dube and Sh M K Das, the Special Central Police Observer for Tripura and Mizoram were also present in the meeting. The Expenditure Observers informed the Commission about Deployment of Flying Squads (FS), Static Surveillance Teams (SST) & Video Surveillance Teams; Complaint Monitoring Cell; Seizures made by FS, SST & Police and Inspection of Candidates Accounts. Commission impressed upon all the Observers to remain on constant vigil and ensure that the polls are conducted in absolutely free, fair and credible manner

ECI/PN/2019, dated10/03/2019 and provisions of Model Code of Conduct for political parties and candidates have come into force from that very date; and Whereas, the Chief Electoral Officer, Bihar, vide his letter dated 16th April, 2019 has forwarded a copy of video clip of the speech delivered by you on 15th April, 2019 at Blocks Barsoi and Barari of Katihar District in Bihar wherein you have made the following statements:- " ..........मैं अपने मुस्लिम भाईयों को एक ही बात कहने आया हूं कि आप ये ऐसी constituency है जहाॅ आप Minority बनके Majority में हो 62 फीसदी constituency में आपका वर्चस्व है ये BJP वाले शडयंत्रकारी लोग आपको बाॅंटने का प्रयास करेंगे। आपके वोट को बाॅंटने का प्रयास करेंगे। मैं कहता हूँ अगर आप इकट्ठे आये तो तारिक साहब को भी दुनिया की कोई भी ताकत हरा नहीं पायेगी" and "..........आज साज़िश हो रही है पूर्णिंया में। मैं आप सब को चेतावनी देने आया हूँ मुस्लिम भाईयों आप 64 प्रतिशत आबादी हो यहाॅं पे। मेरे मुसलमान भाई जितने भी हैं वो ये मेरी पगड़ी है। आप सब लोग पंजाब मे भी काम करने जाते हो पंजाब में हमारी तरफ से प्यार मिलता है, मेहमां जो हमारा होता है जान से प्यारा होता है। अगर आपको कोई दिक्कत हो पंजाब में मैं मंत्री हूं जिस दिन पंजाब आईयेगा सिद्धू को अपने साथ खड़ा पाईयेगा कंधे से कंधा मिलाकर खड़ा पाईयेगा लेकिन मै आपको चेतावनी देने आया हूंॅ बहनों भाईयों ये बाॅंट रहे हैं आपको। मुस्लिम भाईयों वो यहाॅं पे आपको ओबैसी साहब जैसे लोगों को लाकर एक नई पार्टी साथ में खड़ी करके आप लोगों की वोटें बाॅंट के ये जीतना चाहते है। अगर तुम लोग इकट्ठे हुए 64 प्रतिशत आपकी आबादी है Minority Majority में है यहां पे यदि तुम इकट्ठे हुए और इकट्ठे होकर एकजुट वोट डाला तो सब उलट जायेंगे मोदी सुलट जायेगा छक्का लग जायेगा......."; and Whereas, it has been informed that FIR has been lodged against you for these statements under relevant sections of Law in Barsoi Police Station of Katihar District ; and Whereas, your said statement has been widely published in the electronic and print media; and Whereas, Para (3) of part I ‘General Conduct’ of “Model Code of Conduct for the guidance of Political Parties and Candidates”, inter-alia, provides that there shall be no appeal to caste or communal feelings for securing votes, and Para (4) of the said part I provides that all parties and candidates shall avoid scrupulously all activities which are corrupt practices and offences under the election law; and Whereas, sub-section (3) of Section 123 of the Representation of the People Act, 1951, which deals with ‘Corrupt Practices’ provides: “The appeal by a candidate or his agent or by any other person with the consent of a candidate or his election agent to vote or refrain from voting for any person on the ground of his religion, race, caste, community or language or the use of, or appeal to religious symbols or the use of, or appeal to, national symbols, such as the national flag or the national emblem, for the furtherance of the prospects of the election of that candidate or for prejudicially affecting the election of any candidate….”; and Whereas, the Hon’ble Supreme Court of India, vide judgement and Order dated 2.1.2017, in CivilAppeal No 37 of 1992 (Abhiram Singh vs C. D. Commachen), with Civil Appeal No.8339 of 1995, has held that Religion and Caste cannot be used by anyone while making any statement during electioneering or otherwise; and Whereas, the Commission is prima facie of the opinion that you have violated the aforesaid provisions of the MCC and the R. P. Act,1951 and also wilfully disobeyed the aforesaid Order of Hon'ble Supreme Court by making the impugned statements; Now, therefore, the Commission, after considering the available material and extant instructions on the matter, has decided to provide you an opportunity to explain your stand regarding the said statement. Your explanation shall be submitted within 24 hours of receipt of this Notice, failing which the Commission shall take a decision without further reference to you.

Commission's Letter to all CEOs ORDER Whereas, the Commission has announced the schedule for holding the General Election to the House of the People, 2019 vide Press Note no. ECI/PN/23/2019, dated 10/03/2019 and provisions of Model Code of Conduct for political parties and candidates have come into force from that very date; and Whereas, para 2 of Part I ‘General Conduct’ of “Model Code of Conduct, for the guidance of Political Parties and Candidates” provides:- “Criticism of other political parties, when made, shall be confined to their policies and programme, past record and work. Parties and Candidates shall refrain from criticism of all aspects of private life, not connected with the public activities of the leaders or workers of other parties. Criticism of other parties or their workers based on unverified allegations or distortion shall be avoided”; and Whereas, the Commission, vide its letter no. 437/6/INST/2013-CC&BE, dated 28th November, 2013, advised all the political parties and candidates to refrain from any deeds/actions/otherwise that may be construed as being repugnant to honour and dignity of women; and Whereas, the Chief Electoral Officer, Himachal Pradesh vide his letter, dated 16th April, 2019 has forwarded a copy of a video clip of the speech delivered by Sh. Satpal Satti, State President of Bharatiya Janata Party, Himachal Pradesh on 13th April 2019, during a public meeting in Ramshaher of Solan District in Himachal Pradesh, wherein he made the following statement:- आपके परिवार के अन्दर 3 प्राईम मिनिस्टर रहे है। आपको यही पता नहीं लगता की बोलना क्या है। मंच के उपर से नरेन्द्र मोदी जी को चोर बोल रहे है कि चौकीदार चोर है। भाईया तेरी मां की जमानत हुई है, तेरी अपनी जमानत हुई है, तेरी जीजे की जमानत हुई है। पूरे टबर (परिवार) की जमानत हुई है। नरेन्द्र मोदी की न जमानत हुई है, न केस बना है, न किसी ने सजा दी है। तू कौन होता है जज की तरह चोर बोलने वाला। एक पंजाबी व्यक्ति ने फेस बुक पे लिखा । रणधीर शर्मा ने कि मैं आपको बोल के नहीं, मैं आपको बोल नहीं सकता क्योंकि राहुल जी के बारे में हम भी बोल नहीं सकते क्यांेकि ऐ नेशनल पार्टी के लीड़र है और 3 बार कि एम0पी0 है। मैंने कहा लिखा क्या बोल तो दो। बोला लिखा नहीं। आप थोड़ा जरा फेस-बुक पर पढ़ों देखों हमसे भी ज्यादा गुस्सा लोगो को है। उसने लिखा है मै भारी मन से बोल रहा हूं उसने लिखा है कि अगर देश का चौकीदार चोर है और अगर तू बोलता है तो तू श्$$$$$$$$श् है। उसने इसलिए लिखा फेस बुक के उपर यानि लोगो को गुस्सा आता है कि देश के ईमानदार प्राईम मिनिस्टर को जो कहता है कि मैं आने वाला प्राईम मिनिस्टर हूं । मैं इस देश का प्राईम मिनिस्टर बनना चाहता हूं लेकिन मैं इस देश के प्राईम मिनिस्टर को चोर बोलता हूं मचं से खड़ा होकर। Whereas, the said statement of Sh. Satpal Satti has been widely published in the electronic, print media and social media; and Whereas, an FIR no. 21/2019 dated 16.4.2019 under Section 294 of Indian Penal Code and under Section 125 of Representation of the people Act, 1951 has been lodged against Sh. Satpal Satti, State President Bharatiya Janata Party, Himachal Pradesh for his indecent and repugnant comments against President of Indian National Congress and Whereas, the Commission has observed that the impugned statement made by Sh. Satpal Satti is not only indecent but also derogatory and totally uncalled for; and Whereas, the Commission, based on the available evidence and material facts, is convinced that the statement made by Sh. Satpal Satti is in violation of the aforesaid provisions contained in para 2 of Part-1 General Conduct of the Model Code of Conduct and the Commission’s advisory, dated 28th November, 2013; and Now, therefore, the Commission, without prejudice to any Order/Notice issued or to be issued in the matter relating to MCC violations to Sh. Satpal Satti, State President of BJP, hereby, strongly condemns the impugned statement made by him during election campaign held at Ramshaher of Solan District in Himachal Pradesh and reprimands Sh. Satpal Satti for the above said misconduct. The Commission, under Article 324 of the Constitution of India and all other powers enabling in this behalf, bars Sh. Satpal Satti from holding any public meetings, public processions, public rallies, road shows and interviews, public utterances in media (electronic, print, social media) etc. in connection with ongoing elections for 48 hours from 10 AM on 20th April, 2019 (Saturday).
