    No.437 /TEL-HP /2019 Dated: 9th April,2019 NOTICE Whereas, the General Election to the House of People, 2019 has been announced by the Election Commission of India on 10th March, 2019, vide its press release no. ECI/PN/23/2019, dated 10th March, 2019 and the provisions of Model Code of Conduct have come into force from that date as made clear in para- 32 of the said press release; and Whereas, the Commission has called upon all the political parties, candidates and the Union/State Govts. and UT Administrators to strictly adhere to the Model Code of Conduct vide para-32 of the said press release; and Whereas, sub- para (1) of para 1 of the Model Code of Conduct, provides, inter alia, that no party or candidate shall indulge in any activity which may aggravate existing differences or create mutual hatred or case tension between different castes and communities, religious or linguistic; and sub- para (3) of para 1, inter alia, prohibits appeal to communal feelings for securing votes; and Whereas, the Commission has received a complaint from Sh. M Rama Raju, State President, Viswa Hindu Parishad wherein the complainant has stated that you have tried to secure votes by passing derogatory remarks "EE HINDU GAALU......BONDU GAALU......DIKKUMALINA.......DARIDRAPU GAALU" and DESHAM LO AGGI PETALE, GATTAR LEVALE" against Hindus while addressing an election rally at Karimnagar on 17.03.2019; and Whereas, the Commission has obtained English version of the speech delivered on 17.03.2019 and factual report from the Chief Electoral Officer, Telangana and the Commission has examined the English version of the speech; and Whereas, the Commission, is prima facie, of the opinion that by making the aforesaid statement which has the potential of disturbing harmony and aggravating the existing differences between social and religious communities, and appealing to communal feelings, you have violated the above said provisions of the Model Code of Conduct. Now, therefore, the Commission gives you an opportunity to submit explanation, if any in this regard on or before 5 P.M. of 12th April, 2019, failing which the Election Commission shall take a decision without any further reference to you.

    सं. ईसीआई/प्रे.नो./27/2019 दिनांक: 14 मार्च, 2019 प्रेस नोट विषय: भारत निर्वाचन आयोग द्वारा आगामी निर्वाचनों हेतु सामान्‍य, पुलिस और व्‍यय प्रेक्षकों को ब्रीफ करने के लिए पूर्ण दिवसीय सत्र आयोजित करना। भारत निर्वाचन आयोग ने आज लोक सभा और चार राज्‍यों की विधान सभा के आगामी निर्वाचनों की तैयारी के रूप में निर्वाचन होने वाले राज्‍यों में तैनात किए जाने वाले प्रेक्षकों हेतु पहला ब्रीफिंग सत्र आयोजित किया। आईएएस, आईपीएस अधिकारियों तथा साथ ही भारतीय राजस्‍व सेवा और कुछ अन्‍य केन्‍द्रीय सेवाओं से लिए गए 1800 से अधिक वरिष्‍ठ अधिकारियों ने इस ब्रीफिंग बैठक में भाग लिया। इन अधिकारियों को सामान्‍य, पुलिस और व्‍यय प्रेक्षकों के रूप में तैनात किया जा रहा है। प्रेक्षकों को उनकी महत्‍वपूर्ण भूमिका का स्‍मरण करवाते हुए मुख्‍य निर्वाचन आयुक्‍त, श्री सुनील अरोड़ा ने इंगित किया कि अधिकारियों को निष्‍ठावान होने की आवश्‍यकता है और उनके पास कोई विकल्‍प नहीं होना चाहिए सिवाय इसके कि वे यह सुनिश्चित करें कि कोई गलती न की जाए। श्री अरोड़ा ने स्‍मरण किया कि हाल ही में आयोजित राज्‍य निर्वाचनों में ईवीएम-वीवीपीएटी हेतु निर्धारित प्रोटोकाल का अनुसरण करने में चूक की घटनाओं या निर्वाचक नामावली से कुछ नामों के छूट जाने अथवा मतों की गणना में देरी का प्रतिशत नगण्‍य रहा है और पृष्‍ठभूमि में रहकर सभी अच्‍छा कार्य चलता रहा। उन्‍होंने अधिकारियों को याद दिलाया कि लोकतांत्रिक प्रक्रियाओं की आधारशिला के रूप में कार्य करने के लिए वर्ष 1950 से एक विशिष्‍ट संस्‍था के रूप में संस्‍थापित, भारत निर्वाचन आयोग विभिन्‍न कार्यक्षेत्रों के अधिकारियों को इसमें सम्मिलित करता रहा है जो सुपरिभाषित कर्तव्‍यों के अनुसार निर्वाचनों के संचालन में मदद करते हैं। मुख्‍य निर्वाचन आयुक्‍त ने इस बात पर बल दिया कि निर्वाचन प्रक्रिया का पालन करते समय अधिकारी प्रेक्षक के रूप में भारी कर्तव्‍यों का निर्वहन करते हैं और आयोग यह देखता है कि ये अधिकारी यह सुनिश्चित करें कि उन्‍हें विनिर्दिष्‍ट कर्तव्‍यों का वे ईमानदारी से निर्वहन करें। श्री अरोड़ा ने नोट किया कि बदलते हुए समय में धनबल और साथ ही सोशल मीडिया के दुरूपयोग के बारे में सरोकार, नई चुनौतियों के रूप में सामने आ रहे हैं। उन्‍होंने कहा कि भारत निर्वाचन आयोग का प्रयास न केवल स्‍वतंत्र और निष्‍पक्ष निर्वाचन अपितु पारदर्शी, निष्‍पक्ष और नैतिक निर्वाचन भी आयोजित करवाना है। निर्वाचन आयुक्‍त, श्री अशोक लवासा ने समूह को स्‍मरण करवाया कि प्रेक्षक के रूप में उन्‍हें यह सुनिश्चित करने की आवश्‍यकता है कि ईसीआई के सभी अनुदेशों का अक्षरश: कार्यान्‍वयन हो। श्री लवासा ने उल्‍लेख किया कि हाल ही में आरंभ किए गए सी-विजिल ऐप ने आयोग की सहायता करने के लिए प्रत्‍येक नागरिक को सशक्‍त किया है ताकि वे आदर्श आचार संहिता के उल्‍लंघन के संबंध में अपनी आंखे खुली रखते हुए सतर्क रहें। परन्‍तु इस ऐप की उपलब्‍धता ने अपने आप ही निर्वाचन तंत्र का प्रबंधन और निरीक्षण करने वाले अधिकारियों पर और अधिक जिम्‍मेदारी डाल दी है। उन्‍होंने इस संबंध में पुन: उल्‍लेख किया कि प्रेक्षकों को जमीनी स्‍तर पर सभी स्‍टेकहोल्‍डरों के लिए सुलभ और उपलब्‍ध रहने की आवश्‍यकता है क्‍योंकि ये अधिकारी पूरी तरह से ईसीआई का अभिवृद्धित अंग होते हैं। अधिकारियों को संबोधित करते हुए निर्वाचन आयुक्‍त, श्री सुशील चन्‍द्रा ने अधिकारियों का ध्‍यान इस ओर आकर्षित किया कि प्रेक्षक के रूप में उनकी भूमिका आयोग की आंख और कान बनना है ताकि स्‍वतंत्र और निष्‍पक्ष निर्वाचन सुनिश्चित करने में सभी निवारक उपाय किए जा सकें। उन्‍होंने इंगित किया कि व्‍यय प्रेक्षकों की भूमिका तब और भी अधिक महत्‍वपूर्ण हो जाती है जब मतदाताओं को प्रलोभित करने के तरीके भी बहुत अभिनव हों। दिनभर के ब्रीफिंग सत्र के दौरान अधिकारियों को ईसीआई के वरिष्‍ठ उप निर्वाचन आयुक्‍त, उप निर्वाचन आयुक्‍तों और महानिदेशकों द्वारा निर्वाचन प्रबंधन के विभिन पहलुओं के बारे में व्‍यापक और गहन इनपुट दिए गए। निर्वाचन योजना, प्रेक्षक की भूमिका और जिम्‍मेदारियां, निर्वाचक नामावलियों से सम्‍बन्धित मुद्दों, आदर्श आचार संहिता के प्रवर्तन, विधिक प्रावधानों, ईवीएम/वीवीपीएटी प्रबंधन, मीडिया सहयोग और आयोग के अग्रगामी कार्यक्रम स्‍वीप (सुव्‍यवस्थित मतदाता शिक्षा और निर्वाचक सहभागिता) के अधीन चल रहे मतदाता सुविधा सम्‍बन्‍धी कार्यकलापों पर विस्‍तृत विषयक प्रस्‍तुतीकरण दिए गए। प्रेक्षकों को निर्वाचन प्रक्रिया के प्रभावी और कुशल प्रबंधन तथा मतदाता सुविधा हेतु आयोग द्वारा इस क्षेत्र में आरंभ की गई विभिन्‍न आईटी पहल और मोबाइल एप्‍लीकेशनों से परिचि‍त करवाया गया। प्रेक्षकों को ईवीएम और वीवीपीएटी का कार्यात्‍मक प्रदर्शन किया गया और उन्‍हें बहुआयामी तकनीकी सुरक्षा विशिष्टियों, प्रशासनिक प्रोटोकॉल और प्रक्रियात्‍मक सुरक्षापाय, जो ईवीएम ईको-सिस्‍टम को पूर्णत: सुरक्षित, मजबूत, विश्‍वसनीय, छेड़छाड़ रहित और प्रामाणिक बनाते हैं, सम्‍बन्‍धी लक्षणों के बारे में ब्रीफ किया गया। निर्वाचन प्रबंधन के विभिन्‍न विषयों पर सभी विषयक प्रस्‍तुतीकरणों के संकलन, राज्य/संघ राज्‍य क्षेत्र प्रोफाइल और राष्‍ट्रीय निर्वाचन प्‍लानर और निर्वाचन व्‍यय अनुवीक्षण पर अनुदेशों का सार-संग्रह, जैसे व्‍यापक प्रकाशनों का आयोग द्वारा अनावरण किया गया जिन्‍हें प्रेक्षकों को उपलब्‍ध करवाया गया ताकि उनके काम में आसानी हो सके। भारत निर्वाचन आयोग ने पहली बार एक नया मोबाइल ऐप ‘ऑब्‍ज़र्वर ऐप’ शुरू किया है। इस ऐप का प्रयोग करते हुए सामान्‍य, पुलिस और व्‍यय प्रेक्षक सुरक्षित तरीके से अपनी प्रेक्षक रिपोर्ट ईसीआई को प्रस्‍तुत कर सकते हैं जिससे वे मोबाइल ऐप से सुसंगत दस्‍तावेजों को अपलोड कर सकते हैं। प्रेक्षक ड्यूटी पर रहते हुए सभी महत्‍वपूर्ण अधिसूचनाएं, एलर्ट और तत्‍काल संदेश, इस ऐप पर प्राप्‍त करेंगे। यह प्रेक्षकों को उनकी तैनाती की स्थिति, पहचान पत्र डाउनलोड करने और प्रोफाइल अपडेट करने में सुविधा प्रदान करेगा। चूंकि, प्रेक्षक आदर्श आचार संहिता के उल्‍लंघन सम्‍बन्‍धी मामलों के रियल-टाइम निष्‍पादन में पूरी तरह से शामिल रहेंगे इसलिए सी-विजिल ऐप उनके क्षेत्राधिकार में इन सभी मामलों को देखने में मदद करेगा। उड़न दस्‍तों द्वारा मामले की जांच कर लेने के पश्‍चात, प्रेक्षक लिखित टिप्‍पणी कर सकते हैं। निर्वाचन की संपूर्ण प्रक्रिया के दौरान प्रेक्षक ईसीआई के साथ प्रतिनियुक्ति पर होते हैं।

There are two clear vacancies in State Legislative Assembly of Gujarat, which need to be filled up: Sl. No. Number and Name of Assembly Constituency 1. 64 – Dhrangadhra 2. 85 – Manavadar After taking into consideration various factors like, festivals, electoral rolls, etc., the Commission has decided to hold the bye-elections to these 2 Assembly Constituencies following the same schedule as for the relevant Parliamentary Constituency as per the programme mentioned as under: - Sl No. Event Date 1 Issue of Notification 28.03.2019 2 Last date of making Nominations 04.04.2019 3 Scrutiny of Nominations 05.04.2019 4 Last date for withdrawal of Candidatures 08.04.2019 5 Date of Poll 23.04.2019 6 Counting of Votes 23.05.2019 7 Date before which election shall be completed 27.05.2019 ELECTORAL ROLL The electoral rolls of the Assembly Constituencies where bye-elections are being held have been revised with reference to 01.01.2019 as the qualifying date. ELECTRONIC VOTING MACHINES (EVMs) & VVPATs The Commission has decided to use EVMs & VVPATs in the bye-elections in all the polling stations. Adequate numbers of EVMs have been made available and all steps have been taken to ensure that the polls are conducted smoothly with the help of these machines. IDENTIFICATION OF VOTERS In consonance with the past practice, the Commission has decided that the voter’s identification shall be mandatory in the aforementioned bye- elections at the time of poll. Electoral Photo Identity Cards (EPIC) shall be the main document of identification of a voter. However, in order to ensure that no voter is deprived of his/her franchise, if his/her name figures in the Electoral Rolls, separate instructions will be issued to allow additional documents for identification of voters at the time of poll in the said bye-elections. MODEL CODE OF CONDUCT The Model Code of Conduct shall come into force with immediate effect in the district(s) in which the whole or any part of the Assembly Constituencies going for bye-elections is included, subject to partial modification as issued vide Commission’s instruction No. 437/6/INST/2016/CCS, dated 29th June, 2017 (available on the Commission’s website). The Model Code of Conduct shall be applicable to all candidates, political parties and the State Government concerned. The Model Code of Conduct shall also be applicable to the Union Government for the State concerned.

    No. ECI/PN/25/2019 Dated: 12th March,2019 PRESS NOTE Subject: Meeting with the Commission of the three Special Observers appointed for Jammu & Kashmir. The Special Central Observers Dr. Noor Mohammad, IAS (1977, retd) , Sh Vinod Zutshi , IAS (1982, retd) and Sh. A.S.Gill, IPS (1972, retd), appointed by the Election Commission of India for assessment of the situation in Jammu and Kashmir, met with the Chief Election Commissioner Shri Sunil Arora, Election Commissioners Shri Ashok Lavasa and Shri Sushil Chandra at ECI Headquarters in New Delhi today. Shri Sunil Arora, Chief Election Commissioner welcomed the Special Central Observers and thanked them for having accepted this onerous and delicate assignment, which entails assessing the situation of J&K on real time basis in the context of para 62 of the Press Statement given by CEC on 10th March, 2019 while making the announcement of the schedule of elections:- “62.The Commission will be regularly and on real time basis monitoring the situation in J & K and will also be taking inputs from all necessary quarters and decision regarding holding Legislative Assembly elections in J & K will be taken soon.” During the meeting it was requested to the Special Observers that they may kindly visit the State at the earliest, a suggestion which was accepted by them. Shri Ashok Lavasa and Shri Sushil Chandra, Election Commissioners also briefed them during the interactive session which lasted for almost 2 hours. DEC-in-charge of the State Mr. Sandeep Saxena briefed them about preparedness of election in J&K and gave other details regarding the State. The Commission discussed with them about their roles and responsibilities. The three Central Observers would be required to visit the State and make a real time assessment of the situation by meeting Political Parties, district and state authorities and other stake holders. Shri A S Gill has wide experience in field of security management in difficult areas. He was IG:CRPF in J &K between 1995-97 and subsequently superannuated as DG:CRPF. Dr. Noor Mohammad, a former Secretary to Government of India has worked more than a decade in the fields of election management as Chief Electoral Officer of Uttar Pradesh, Deputy Election Commissioner in ECI, international expert and consultant on election in Afghanistan for many years. Shri Vinod Zutshi, former Secretary in the Central Government also has wide experience for more than a decade in elections at the state level as CEO, Rajasthan and at the ECI level as Deputy Election Commissioner for more than five years.
